These Terms of Service (“Terms”) govern your access to and use of the websites, mobile applications, and other services provided by Swicelso LLC (“Swicelso”, “we”, “us”, or “our”) (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

You retain ownership of the content you submit through the Services (“User Content”). You grant Swicelso a worldwide, non-exclusive, royalty-free license to host, store, and process your User Content solely as necessary to operate and improve the Services.

5. Intellectual property

The Services, including all software, design, text, graphics, and trademarks, are owned by Swicelso or its licensors and are protected by intellectual property laws. Except for the limited license granted in these Terms, no rights are transferred to you.

6. Third-party services

The Services may integrate with or rely on third-party services. We are not responsible for those services and your use of them is governed by their own terms.

7. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time if you violate these Terms or if we reasonably believe doing so is necessary to protect the Services, our users, or third parties.

8. Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWICELSO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify and hold Swicelso harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services or violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts located in Wyoming, unless otherwise required by applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the “Last updated” date above. Continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.
